1. SCOPE OF THESE TERMS OF SERVICE

These are general terms of service (hereinafter referred to as “Terms of Service”) of Pregenic Solutions Pvt. Ltd., a company incorporated under Companies Act, 2013 having corporate office at C-63 Sivad Area, Bapu Nagar, Jaipur-302015, Rajasthan bearing Corporate Identity Number U85190RJ2022PTC079393; info@pregenics.in; +91 6377 982 926, (hereinafter “Pregenic”, “we”, “ours”, “us”).

WHEREAS, Pregenic intends to provide services and products for DNA genotyping, post analysis of results, along with providing a wide range of products that would bring awareness amongst the customers regarding genetic predispositions to more than 165 genetic diseases at affordable prices in India, by utilizing artificial intelligence and state of the art technology (hereinafter referred to as “Services”). The aforesaid is subject to further addition of the allied services and products provided to the customers (hereinafter referred to as “customers”, “you”, “yours”, etc.). The Services are made available at our website https://pregenics.in/ as well as any related subdomain websites (collectively hereinafter referred to as the “Website“).  

WHEREAS, the Terms of Service govern your use of the Website and the Services rendered by Pregenic.

2. YOUR ACCEPTANCE OF THESE TERMS OF SERVICE

By using our Services, you agree to be bound by these Terms of Service. It is voluntary for you to accept our Terms of Service, however, if you cannot accept our Terms of Service, we will not be able to make the Services available to you. Please note that we cannot accept orders from customers under the age of eighteen (18) years or from customers otherwise barred from receiving the Services under the Indian laws.

3. DATA COLLECTION AND PRIVACY

We collect your data in compliance with the relevant local laws. Your data is harnessed and converted into an actionable intelligent output by employing the state-of-the-art technology in genetics research and analysis which will help to understand existing and emerging risks. Please note that, your genetics data, i.e., saliva sample, is anonymised prior to sending it to our partner labs for its evaluation. Further, any saliva sample, data, including your contact details and address or the report generated after analysing the saliva sample is kept confidential at all times and is processed in furtherance of our Privacy Policy and local data privacy laws. Upon any change in the Privacy Policy, we shall update the same on our Website, in order to stay updated with our Privacy Policy and the use of your data, you should review our Policies periodically.

4. PURCHASING OUR SERVICES AND SHIPPING

Our Services can be purchased from our Website, a detailed process is provided therein with relevant instructions to be followed while ordering a test kit for the collection of your saliva sample. You are required to place an order and upon the arrival of the test kit and putting your saliva sample in the container provided, you are required to send the collected saliva sample to the designated address as per the prescribed method on the instruction manual of the test kit. Please note that it important that you follow the instructions carefully for us to be able to preserve your sample and accurately analyse it without any errors. In addition to that, after collecting the saliva sample, you are required to activate the test kit from our website that instructions you have received in the test kit.

You are requested to visit the “Webstore” page on our Website to understand the process in detail prior to placing an order. Further, the test kit shipping service is provided as a part and parcel of the Services as envisaged under these Terms of Service.  The Service charges are inclusive of shipping fee for pan India.

5. CANCELLATION AND REFUND

The Cancellation and Refund request will only be entertained within 24 hours of placing an order, only upon a written request to do so on our designated email or WhatsApp number informing us of such cancellation and seeking refund. Such request(s) will be processed within 30 days from the date of such intimation/request in writing. Furthermore, if the cancellation request is received after the dispatch of the test kit, Pregenic will deduct a sum of INR 1700 from the amount to be refunded.

Furthermore, please be informed that if the initial processing of your DNA sample fails for any of the reasons that is not attributed to you, such as following proper instructions in collecting and sending the sample to the designated address, we will reprocess the sample at no additional charge for a second time after sending a new test kit. However, if, even after that the processing of the sample is not executed successfully on account of the reasons beyond our control, we shall initiate a refund after deducting shipping and handling charges, provided the failure to process the sample must not have been caused by you in any manner whatsoever, including but not limited to, failure to adhering to instructions on the test kits or these Terms of Service.

6. DISCLOSURES AND DISCLAIMER

Please note that we do not provide medical advice. For you to further interpret and assess the meaning of your test results, we firmly advise that you consult your own doctor or other qualified health care provider. It is stated that the health risks and potential predispositions for certain diseases rely on many other factors apart from genes, including environmental factors and lifestyle choices. Therefore, if your result/data indicates you are at an elevated genetic risk for a particular disease or condition, it does not mean you will definitively develop the disease or condition at some point in your life.

It is stated for your information and as a disclaimer that for the analysis we use two in-house developed algorithms. Firstly, we use a genetic marker matching algorithm and secondly a polygenic risk score algorithm with the view to generate an easy to read to report for you. Furthermore, we may not be able to process your DNA sample, and the laboratory process may result in errors, e.g. the results from processing may not meet our standards for accuracy and any such errors as specified under these Terms of Service or any other document made available to you may be a potential reason for such an error that is out our control.

Therefore, it is again reiterated that the DNA sample analysis employed by us is not 100% accurate or involves medical research and computer sciences and, sometimes, is prone to result in potential errors.

We will ensure the best industry practices from our end in providing you our services. Nevertheless, we hereby disclaim all kinds of liability and claims that may arise in relation to the interpretation and analysis of your sample and/or report generated by us.

7. COMPLAINTS

In the event you are not satisfied with our Services or you need to raise any complaint, claim or dispute pertaining to the contractual relationship between you and Pregenic, you are required to contact us at our designated contact details and we will carry out necessary amends and take appropriate actions to remedy the situation/fault.

8. DISPUTE RESOLUTION

In case of any dispute or difference that may arise between the parties hereto, out of or under or in connection with the Services provided by Pregenic to a customer, the same shall be adjudicated by reference to arbitration of a sole Arbitrator to be mutually appointed by the Parties hereto.  The decision of the Arbitrator shall be final and binding on the Parties. Such arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996 including any statutory modifications thereof.  The seat and venue of any such arbitration shall be exclusively Jaipur, Rajasthan.  The Parties further hereby agree that the courts of Jaipur alone shall have jurisdiction.
